Annotations
In its meeting of June 20, 2008 the Advisory Board unanimously reached the following decision: The Advisory Board cannot recommend to the Federal Minister for Education, the Arts and Culture that the painting be handed over to the legal successors of Salomon Rosenzweig (or to the successors of a third party). Reasons for the non-recommendation: In 1963, the painting was transferred to the Collection Agency A. This is equivalent to the restitution of the painting to the aggrieved owners, as their claim to restitution had previously been transferred by law to the Collection Agency. The requirement of Section 1 item 2 of the Art Restitution Law is therefore not met, as objects that were restituted after 1945 fall outside the scope of application of this law. Therefore, no further resolution of the question whether the painting actually belonged to Samuel Rosenzweig or to a third party is required.
